Judgment

The petitioner is stated to be working as Safai Karamchari in the office of the CEO, Shillong Municipal Board, Shillong and her case is that she has been working continuously but for unknown reasons, she was thrown out of her employment and was not allowed to continue her duties.
An affidavit has been filed by the respondent No. 2 wherein in para 10 it had been stated that as a special consideration in view of her dire condition, the respondents are willing to consider reinstatement of the petitioner subject to her giving an undertaking by way of an affidavit before this Court.
The petitioner by way of the rejoinder affidavit at para 3 has furnished the said undertaking which is reproduced herein below:
“I give my undertaking by way of affidavit before this Hon’ble High Court that upon my reinstatement of my service under the Shillong Municipal Board, Shillong, I shall not be absent from duty without prior intimation to my superiors. I shall work diligently and see that the work is done thoroughly and cleanliness is maintained for the work allotted by my superiors of the Shillong Municipal Board Office, Shillong.”
In view of the consideration given by respondent No. 2 and the undertaking as made out by the petitioner, nothing remains for consideration before this Court and the matter is accordingly closed and disposed of. However, it is to be noted that this will not serve as a precedent for any matter as the case of the petitioner was taken as a special consideration.
The petitioner on receipt of a certified copy of this order, shall report before respondent No. 2 for necessary orders and directions.
Writ petition stands closed and disposed of.
