Judgment
Kanwaljit Singh Ahluwalia, J.—Learned Counsel for the Petitioners contends that the Petitioners have lodged case FIR No. 80 dated 15.4.2007, registered at Police Station Payal, District Ludhiana, under Sections 325, 323 and 34 IPC against the private Respondents. He further submits that thereafter on 5.4.2011 at about 6.00 P.M., Respondents No. 5 to 11 came armed with dangs and criminally trespassed into the house of the Petitioners. The private Respondents are compelling the Petitioners to compromise the matter and not to depose against them.
Issue notice of motion to Respondents No. 1 to 4 only.
On asking of the Court, Mr. J.S. Bhullar, Assistant Advocate General, Punjab, accepts notice on behalf of Respondents No. 1 to 4.
It is stated that challan in the above said FIR has already been filed. The Petitioners may file an application in the concerned Court for Witness Protection. As and when such an application is filed the concerned Court, after assessing the threat perception to the life of the Petitioners, shall device Witness Protection Programme and life of the Petitioners shall be protected. Learned Counsel for the Petitioners submits that such an application shall be filed within a period of ten days. Till such an application is filed, Respondent No. 4-Station House Officer, Police Station Payal, Ludhiana, shall ensure necessary vigil that no harm is caused to the life of the Petitioners.
With the observations made above, the present petition is disposed of.
