This is an application for grant of bail to the petitioner during pendency of the Criminal Revision.
The petitioner has been convicted by the learned J.M.F.C., Udayagiri in G.R. Case No.120 of 2012 (T.R. No.189 of 2012) for commission of offence under Sections 498 (A) of I.P.C. read with Section 4 of the D.P. Act vide judgment and order dated 26.11.2019 and sentenced to undergo S.I. for a period of one year for the offence under Section 498(A) IPC and to pay a fine of Rs.10,000/- (ten thousand) and in default to undergo S.I. for six months. The said conviction was confirmed by the learned Addl. District and Sessions Judge, Balliguda vide judgment and order dated 29.07.2021 in Criminal Appeal No.07 of 2019 but he has reduced the default sentence of six months to two months.
Learned counsel for the petitioner states that the petitioner was all along on bail during trial and during pendency of the Criminal Revision. He further states that during pendency of Criminal Revision, N.B.W. of arrest has been issued against the petitioner.
Considering the above submission, it is directed that in the event, the petitioner surrenders before the learned trial court by 24.12.2021, N.B.W. of arrest issued against him shall be recalled and he shall be released on bail during pendency of the Criminal Revision, by the learned trial court on such terms and conditions as deemed fit and proper by it.
The I.A. is disposed of.
