Considering the submission that original R.C.Book of the vehicle has been lost, this Court by earlier order dated 9th June, 2021 has directed for production of duplicate R.C.Book duly granted by the competent authority.
It is contended by the learned counsel for the Petitioner that, the duplicate certificate granted by the competent authority i.e. the R.T.O., Chandikhol was obtained by the Petitioner upon deposit of requisite fees of Rs.200/-. But the learned Magistrate has declined to accept the same as a valid document in its order dated 28th June, 2021. In support of his contention, the Petitioner produces copy of the duplicate certificate and original smart card as well as copy of the fee receipt. Rule 28 of the Orissa Motor Vehicle Rules, 1993 prescribes for issuance of certified copy of the R.C.Book on deposit of fees of Rs.200/-.
Considering the submissions and upon perusal of the copies of duplicate certificate and the registration card, no impediment is seen in accepting the same.
Accordingly, the learned J.M.F.C., Ranpur is directed to pass necessary orders accepting the said documents produced by the Petitioner in terms of the earlier order dated 9th June, 2021 passed by this Court.
The I.A. is disposed of.
