Judgment
On 01/05/2018, this Court had directed the Under Secretary, Department of Home (Police) to file a detailed affidavit so far as the similarly placed petitioners under the same category or in any other category in the State of Chhattisgarh.
Today, an affidavit has been filed by one Dashrath Prasad Koushal - the Under Secretary which is totally unsatisfactory and does not provide any details which was expected as per the order passed by this Court on 01/05/2018.
The affidavit show that there are couple of persons of similar nature working in the State of Chhattisgarh and in whose favour there is an order also passed by the State of Chhattisgarh, but the Under Secretary has failed to disclose as to under what authority of law, provision of law or whether the same has been with the concurrence or approval of the Government of India or not?
The affidavit so filed by the Under Secretary is only a superfluous affidavit without serving purpose and object of directives given by this Court.
Thus, let a detailed affidavit be filed by the Under Secretary positively by the next date of hearing.
He shall also remain present on the next date of hearing along with all the relevant files so far as the case of Jyoti Jawrani and Shweta Sinha Shrivastava is concerned and shall also keep documents pertaining to the petitioner.
List it for further consideration on 21/06/2018.
