Petitioner has filed appeal before Administrative Tribunal vide Municipal Appeal No.50/2026 against the order dated 31st August 2026 passed by the Chief Officer of Mormugao Municipal Council in Case No.MMC/CO/Order/2026/43. Petitioner has also filed application seeking stay of the order impugned before the Administrative Tribunal.

It is submitted that Petitioner's application for stay to the order of the Chief Officer was not taken up for hearing and Petitioner was apprehending adverse action at the hands of the Chief Officer in pursuance to order dated 31st August 2026, he approached this Court, seeking interim protection from implementation of order dated 31st August 2026.

This Court finds that present writ petition can be disposed of by way of innocuous direction to the Administrative Tribunal/Principal District Judge to decide the Petitioner's pending application for stay or hear appeal finally within a period of four weeks from the date of this order. Till the learned Principal District Judge decides Petitioner's application for stay or appeal, no coercive steps shall be taken against the Petitioner in pursuance to the order passed by the Chief Officer of Mormugao Municipal Council.

Needless to state here that this Court has granted interim protection to the Petitioner without delving into contentions on merits and the learned Principal District Judge shall pass further orders on either the stay application or appeal based on its own merits without being influenced by this order.

Writ Petition stands disposed of in the aforesaid terms.
