Judgment
Sole appellant along with Munna Rai stand convicted for the offence punishable under Sections 20 (b) (ii) C of the NDPS Act by the impugned judgment dated 21.08.2021, passed in N.D.P.S. Case No. 01/2019 by the learned Dist. and Additional Sessions Judge-III-cum-Spl. Judge, NDPS Act, Koderma, and both of them have been sentenced to undergo rigorous imprisonment for 20 years with a fine of Rs. 2,00,000/- each and a default sentence each by the impugned order of sentence dated 26.08.2021.

Call for the L.C.R. in connection with N.D.P.S. Case No. 1/2019 from the court of learned Dist. and Additional Sessions Judge-III-cum-Spl. Judge, NDPS Act, Koderma.
Prayer for suspension of sentence made through I.A. No. 6163 of 2021 shall be considered after receipt of the L.C.R.
Office to verify as to whether the other convict Munna Rai has preferred any appeal or not.
Learned A.P.P. would enquire as to the status of the investigation against other accused persons since from para-3 of the impugned judgment, it appears that while submitting charge sheet against these two accused / appellant, investigation was kept pending against other accused persons. Whether they have been charge sheeted, if so, what is the status of their trial? Let an affidavit to that effect be filed within a period of four weeks.
