Judgment
Accused in S.C.No.5034/2025 pending before the Court of VIII Addl. District & Sessions Judge, Mysuru, sitting at Hunasuru, arising out of Crime No.231/2025 registered by K.R.Nagar Police Station, Mysuru District, for the offences punishable under Sections 75(3), 308(2), 108 of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail.
Heard the learned Counsel for the parties.
FIR in Crime No.231/2025 was registered by K.R.Nagar Police Station, Mysuru District, for the offence punishable under Section 108 of BNS, 2023, against the user of phone bearing No.7022872996. In the said case, petitioner was arrested on 04.06.2025 and remanded to judicial custody. After completing investigation, charge sheet has been filed against him for the aforesaid offences. His bail application filed before the Trial Court in S.C.No.5034/2025 was rejected on 15.10.2025. Therefore, he had approached this Court in Crl.P.No.15662/2025 which was dismissed as withdrawn on 09.04.2026. It is under these circumstances, petitioner is before this Court in this successive petition.
Perusal of the material on record would go to show that petitioner and the deceased were acquainted to each other. The charge sheet material would go to show that both were pursuing their studies. In the charge sheet, it is alleged that petitioner had represented to the deceased that he was working as a Manager in a Star Hotel and was drawing monthly salary of Rs.80,000/-. He allegedly had induced her to accompany him to a hotel on 07.04.2025 and inside the room in the said hotel, he had recorded certain videos. Subsequently, deceased started avoiding the petitioner, and therefore, he started threatening her of circulating the photos and videos which he had recorded. It is under these circumstances, the victim allegedly had committed suicide on 29.05.2025.
Petitioner is in custody from 04.06.2025 onwards. Investigation of the case is completed and charge sheet has been filed. Learned HCGP has fairly submitted that during the course of investigation, mobile phone of the petitioner was recovered and no private photos or videos of the deceased was found in the said phone. Trial in the case is not yet commenced. The alleged offences are not punishable with death or life imprisonment.
Considering the aforesaid aspects of the matter, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order:
The petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.5034/2025 pending before the Court of VIII Addl. District & Sessions Judge, Mysuru, sitting at Hunasuru, arising out of Crime No.231/2025 registered by K.R.Nagar Police Station, Mysuru District, for the offences punishable under Sections 75(3), 308(2), 108 of BNS, 2023, subject to the following conditions:
Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
The petitioner shall not involve in similar offences in future.
