Election to the Managing Committee of the 4th respondent Bank is scheduled to be held on 26-07-2023. The petitioner has approached this Court with a complaint that names of nearly 796 persons set out in Ext.P10 list have been included in the electoral roll at the instance of the electoral officer, though such persons are no longer alive.
The learned Standing Counsel appearing for the Election Commission submits that the persons mentioned in Ext.P10 list were included in the final electoral roll only on the basis of Ext.P6, where it is stated that since the details regarding the death of the persons mentioned in Ext.P10 cannot be produced (considering the time lines involved) they may be included in the voters list.
The learned counsel for the petitioner would submit that the only prayer sought for by the petitioner is that the votes, if any, cast by the persons mentioned in Ext.P10, be kept in a separate box, so that it may be easier to identify as to whether any bogus vote have been cast in the name of persons who were no longer alive, by impersonation etc.
Having heard the learned counsel for the petitioner, learned Standing Counsel for the State Co-operative Election Commission and the learned counsel appearing for the respondent Bank, this writ petition will stand disposed of directing that the votes, if any, cast by the persons mentioned in Ext.P10, shall be kept in a separate box and at a separate counter, to be mentioned for that purpose, by the Election Commission. No prejudice is caused to any person if such direction is issued. It is made clear that if any votes are actually cast by the persons mentioned in Ext.P10 list, the same can be counted and results of the election can also be declared.
The writ petition is disposed of as above.
