Santan Singh And Another vs State Of Uttarakhand

Applicant no.2-Mahendra, who is in judicial custody in Case Crime/ FIR No.01 of 2025, under Sections 179 and 181 of BNS, registered at P. S. Guradsyun-3, District Pauri Garhwal, has sought his release on bail.

Heard learned counsel for the parties and perused the material available on record.

As per the FIR, four persons, including the applicants, Deepak, and Rahul, were apprehended by local residents and market vendors at Sanglakoti Market while possessing counterfeit currency notes; that, the complainants suspected the involvement of a larger gang operating in the area and requested appropriate police action and information regarding the steps taken against the accused.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case; that, no counterfeit currency notes of any kind have been recovered from the possession of the applicant, nor has any equipment for printing fake currency been seized from him; that, the name of the applicant was added at the end of the recovery memo prepared by the Investigating Officer.

Learned counsel for the applicant has further submitted that during investigation, applicant no.1– Santan Singh and the other two co-accused persons have been exonerated, while only applicant no.2–Mahendra has been charge-sheeted.

Per contra, learned counsel for the State has opposed the bail application.

Considering the facts and circumstances of the case and without expressing any opinion about merits of the case before the Trial Court, this Court is of the view that this is a fit case for bail.

The bail application is thus, allowed and the applicant is directed to be released on bail on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
