Prayer in this petition is for grant of regular bail in FIR No.152 dated 26.12.2021 under Sections 307, 323, 148, 149 IPC, registered at Police Station Division No.1, Jalandhar.

Learned counsel for the petitioner submits that the petitioner is in custody for the last 04 months and 21 days; he is not involved in any other case; challan stands presented and it will take some time in conclusion of the trial. It is further submitted that as per allegations in the FIR, registered at the instance of one Roshan Lal, the petitioner gave a baseball bat blow on head of his father Nanak Ram, who is an old man. It is also submitted that though the injury attributed to the petitioner is declared dangerous to health, however, without prejudice to his right of defence, he is ready to compensate victim Nanak Ram by paying Rs.75,000/- towards medical expenses, as the investigation is complete.

Learned State counsel has filed the custody certificate in the Court today and has not disputed the factual position, however, it is submitted that victim Nanak Ram remained admitted in hospital for a long time.

After hearing learned counsel for the parties, without commenting anything on merits of the case and considering the fact that the petitioner is in custody for the last 04 months and 21 days; he is not involved in any other case; challan stands presented and he has volunteered to pay Rs.75,000/- by way of demand draft to the victim towards medical expenses, this petition is allowed and the petitioner is directed to be released on regular bail subject to furnishing his bail/surety bonds to the satisfaction of the trial Court/Illaqa Magistrate/Duty Magistrate, concerned.

This will, however, be subject to the condition that while furnishing bail/surety bonds, without prejudice to his right of defence, the petitioner will submit a demand draft of Rs.75,000/- favouring victim Nanak Ram before the trial Court/Illaqa Magistrate, which will be handed over to the victim.
