Today, when the matter was taken up for hearing, the learned counsel appearing for the petitioner would submit that the petitioner is not pressing the present writ petition, since a civil suit in respect of the very same issue is pending and therefore, nothing survives for further adjudication in this writ petition.

Recording the aforesaid submission, the present writ petition is dismissed as withdrawn, leaving it open to the petitioner to raise all the grounds before the competent civil Court in the pending civil proceedings. No costs. Consequently, the connected miscellaneous petition is closed.
