Judgment
The petitioner's grievances revolve around a written complaint dated 23.05.2019 in which she had alleged assault on her husband which allegedly took place on 23.05.2019 at about 5 p.m. Against the husband of the petitioner also a cross case was lodged. He had therefore approached this Court by filing anticipatory bail application No.68 of 2019 in which he had complained of proper investigation not been carried out by the investigating agency in connection with the said complaint lodged by his wife. The learned Judge had made certain observations.
Subsequently the daughter of the petitioner had also filed a complaint dated 16.06.2019 before the Government Railway Police which according to her was a sequel of the previous incident.
Counsel for the petitioner submitted that the investigating agency is not carrying out fair and impartial investigation. In the counter cases lodged against the husband of the petitioner charge sheet has been filed whereas in the two cases filed by the petitioner and her daughter investigation is moving at a slow speed.
Learned Public Prosecutor under instructions stated that investigation in relation to the petitioner's complaint dated 23.05.2019 is virtually over. Statements of all witnesses including the complainant and injured witnesses have been recorded. Charge sheet will be presented within a few days. He further stated that in relation to the complaint lodged by the daughter of the petitioner before Government Railway Police the charge sheet has already been filed.
In view of the said statement no further directions are necessary. It is expected that the investigation in relation to the petitioner's complaint would be completed expeditiously and charge sheet if the investigation reveals commission of offences would be filed before the concerned Magistrate.
The petition is disposed of accordingly.
