Judgment
This present application has been filed seeking clarification of the Judgment and Order dated 24.05.2023 passed by this Court in connection with Criminal Appeal (J) No. 09 of 2022.
Ms. Purukayastha, learned counsel appearing for the applicant, submits that this present application has been filed to clarify whether the modified sentence of five years passed under Section 304 Part II of IPC (in place of Section 304 Part I) is to run consecutively or concurrently with the sentence under Section 498A IPC.
Heard and perused the records.
It is clarified that the Court below had directed the applicant to undergo imprisonment for 3(three) years under Section 498A IPC. Upon examination of the matter in its entirety, this Court modified the conviction from Section 304 Part-I of IPC to Section 304 Part II of IPC, with a sentence of five years. Accordingly, the sentence under Section 498A of IPC and Section 304 Part II of IPC, both shall run concurrently.
The Judgment and Order dated 24.05.2023 stands clarified accordingly. Consecutively, this present interlocutory application is disposed of.
