Judgment
Kurian Joseph, C.J.—The Appellant is the writ Petitioner. The matter pertains to the contract for construction of a road. The learned Single Judge, despite rendering a finding that the Petitioner was not qualified, it appears that the Petitioner has been permitted to participate in the fresh tender process. The Petitioner apprehends that in the process though he was the lowest originally, other unqualified persons will be awarded the work. On 24th May, 2011, this Court passed the following order, which reads as follows:
Learned Deputy Advocate General seeks time to get instruction from the fifth Respondent as to whether any unqualified person has been selected for award of the work. We make it clear that only qualified persons shall be considered for award of the work. Post on 31.5.2011.
In view of the order, as above, the Petitioner need not have any apprehension that unqualified persons will be considered for the award of the work. Therefore, this order is made absolute and the appeal is disposed of, as above, making it further clear that to the above extent the judgment of the learned Single Judge stands modified.
