The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking reimbursement of medical expenses from Indian Railways.
Learned counsel for the respondent, at the outset, submits that Central Administrative Tribunal (for short ‘CAT’) is vested with jurisdiction of matters relating to employees of Indian Railways, thus, petitioner has appropriate remedy to approach CAT.
Faced with this, learned counsel for the petitioner submits that the matter may be transferred to CAT, Chandigarh Bench.
Learned counsel for the respondents submits that she has no objection to aforesaid arrangement.
In the wake of statements of both sides, the present petition along with pending applications stands transferred to CAT, Chandigarh Bench. The Registry is directed to send complete record of the case to CAT, Chandigarh Bench.
The petitioner, at first instance, would appear before CAT, Chandigarh Bench on 30.01.2024 and thereafter, as directed by the Tribunal.
