The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking directions to the respondents to make correct calculation with respect to entitlement of petitioner for leave encashment.

Mr. Somesh Gupta, learned counsel for the respondents, while pointing out reply, submits that matter is under active consideration, however, final decision could not be taken due of pendency of present petition.

Faced with this, learned counsel for the petitioner seeks permission to withdraw the present petition, however, prays that respondents may be directed to decide claim of the petitioner in a time bound manner.

In the wake of statements of both sides, the present petition stands disposed of with a direction to the respondents to decide claim of the petitioner within three months from today.
