By way of instant petition filed under Article 226 of the Constitution of India, petitioners have prayed for following relief:-

i) That the factor of qualification may be read down and the respondents may be ordered to appoint the petitioners/convert their posts as Pump Attendant from the dates the other similarly situated persons have been appointed/converted, with all the benefits identical thereof.

Learned counsel for the parties are ad-idem that case of the petitioners is squarely covered with judgment dated 5.3.2021, passed by this Court in CWP No. 1320 of 2021, titled Ved Prakash and others v. State of HP and Ors.

Having carefully perused aforesaid judgment rendered by this court, this Court finds that case of the petitioners is identical to the aforesaid case decided by this Court. Vide judgment dated 5.3.2021, this Court has already dealt with all the points raised in the instant petition and as such, respondents can be directed to decide the case of the petitioners in light of the aforesaid judgment rendered by this court.

Consequently, In view of the above, the directions contained in the aforesaid judgment are ordered to be made mutatis mutandis applicable in the present case for all intents and purposes. In the aforesaid terms, present petition is disposed of alongwith pending application(s), if any.
