The challenge in the present Appeal is to an order dated 15.12.2020, passed by learned Civil Judge (Senior Division) Tehri Garhwal in Civil Suit No.11 of 2020, “Sanjeev Katyal and Another vs. Siddhartha Prasad and Others”, by which, the temporary injunction application, filed by the appellants – plaintiffs, has been dismissed.

Heard Mr. Siddhartha Sah, learned counsel for the appellants and Mr. Piyush Garg, learned counsel with Mr. Nikhil Singhal, learned counsel for the respondents.

Both, the learned counsel for the appellants and the learned counsel for the respondents have requested to decide the present appeal directing the Trial Court to decide the said original suit within a period of two months.

In view of the submissions made by learned counsel for the parties, the present Appeal (AO No.48 of 2021) is being disposed of with a direction to the Trial Court to expedite the said Original Suit No.11 of 2020 and decide the same expeditiously preferably within a period of two months from the date of receipt of the certified copy of this order.

It is made clear that this Court has not expressed any opinion on the merit of the case.
