Judgment

In the present writ petition, the petitioner is praying for issuance of a writ in the nature of certiorari for quashing the charge-sheet dated 03.10.2019 (Annexure P-9) as well as the order dated 01.06.2020 (Annexure P-12) whereby the Enquiry Officer was appointed to enquire into the charges in terms of the charge-sheet dated 03.10.2019 (Annexure P-9) without supplying the incriminating material.
Learned counsel appearing on behalf of the petitioner submits that during the pendency of the present writ petition, the petitioner has met with an accident and suffered a permanent disability, as such, he is not in a position to associate himself in an enquiry. Learned counsel for the petitioner, on instructions from the petitioner, submits that he will be satisfied, if liberty is granted to the petitioner to file a representation in regard to dropping of charge-sheet taking into consideration the fact that the petitioner is not in a position to associate himself in an enquiry due to his health condition and a direction be given to the respondent to decide such representation submitted by the petitioner in a time-bound manner.
Learned State counsel does not oppose the prayer made by learned counsel for the petitioner.
In view of the above and without commenting upon the merits of the case, the present petition is hereby disposed of with liberty to the petitioner to file representation in regard to dropping of charge-sheet. In case, such representation is filed by the petitioner, the same shall be considered and decided by the respondent, in accordance with law, within a period of 02 months from the date of submission of such representation by the petitioner.
Pending application(s), if any, shall also stand(s) disposed of.
