Judgment
Savitri Ratho, J
Perused the status report dated 17.05.2024 of the learned J.M.F.C. (II), Cuttack wherein it has been stated that chargesheeet dated 30.12.2023 has been submitted in this case under Sections 419, 420, 467, 468, 471 and 34 of IPC against 06 accused persons, namely, 1.Dipalika Mohanty, 2.Sanjay Kumar Nayak, 3. Bibhuti Jena, 4. Manas Ranjan Nayak, 5. Bishal Bhanja @ Bishal and Srinibas Nanda. In the meanwhile, the accused persons, namely, Bishal Bhanja, Manas Ranjan Nayak and Srinibas Nanda have been released on bail on 22.12.2023 in compliance to the order passed by this Court in BLAPL No.10837 of 2023, BLAPL No.10961 of 2023 and BLAPLl No.10874 of 2023. Presently, the co-accused, Dipalika Mohanty, the present petitioner-Sanjay Kumar Nayak and Bibhuti Jena are in custody since 03.09.2023.
Mr. M.R.Dhal, learned counsel for the petitioner submits that the status report is incorrect to the extent that co-accused Bibhuti Jena has been granted bail in BLAPL No.10873 of 2023 but Bishal Bhanja @ Bishal’s prayer for bail has been rejected in BLAPL No.11392 of 2023 for which he has filed BLAPL No.1420 of 2024 which is pending before this Court.
List this matter tomorrow (21.05.2024) alongwith BLAPL No.1420 of 2024.
Copy of this order be sent to the learned J.M.F.C.-II (Cog. Taking), Cuttack affording him/her an opportunity to submit correct particulars alongwith an explanation for submitting incorrect information to this Court.
