Judgment
This Appeal has been filed against the order dated 23.06.2023 passed by the Adjudicating Authority (National Company Law Tribunal), Mumbai Bench, by which Application under Section 7 of the IBC filed by the Financial Creditor has been admitted. In this Appeal, an interim order was passed by this Tribunal on 07.07.2023, which is to the following effect:-
“In the meantime, no further steps in pursuance of the order dated 23.06.2023 shall be taken till the next date.”
An I.A. 3697 of 2023 has jointly been filed by both the parties bringing on record Consent Terms dated 09.08.2023 between the parties. It is submitted that the parties have settled their issues and there is no necessity to continue the CIRP any further.
Learned Counsel for the Appellant further submits that the IRP fees which was fixed by the Adjudicating Authority shall be paid to the IRP as per the Consent Terms.
In view of the aforesaid, we accept IA No.3697 of 2023 on record. CIRP is closed. The Appeal is disposed of.
