Heard on the question of interim relief.
Counsel for the petitioner submits that in the year 2014 an F.I.R. was registered against some persons under Sections 420, 467, 468, 471(ka), 120B of IPC read with Section 3(1-2), 4 of The Madhya Recognized Examinations Act & Sections 65, 66 of IT Act read with Section 13(1)(D)/13(2) of Prevention of Corruption Act. Thereafter, in additional charge-sheet, the name of the present petitioner surfaced and in consequence thereof since the offence involved moral turpitude the petitioner was suspended. It has been submitted that number of persons who have been involved in the aforesaid crime had approached the main Seat at Jabalpur and at Indore and they have been granted interim relief and their suspensions have been stayed. Along with the petition, copies of interim orders have been filed.
Looking to the nature of controversy and relief granted to the similarly situated persons and keeping parity with the orders passed by the Benches at Jabalpur and at Indore, this Court deems it fit to stay the effect and operation of the order dated 23.03.2021 (Annexure P/1). Accordingly, the same is stayed till the next date of hearing.
Issue notice to the respondents on payment of process fee within seven working days through registered A.D. mode, returnable within four weeks.
List this case along with Cases No.W.P. No.27719/2023 and W.P. No.10138/2023.
