R.P. Yadav, J.—Heard learned Counsel for the petitioners and the learned A.G.A.

It is urged that the case was initially registered under Section 326/323/504/506 I.P.C. at case Crime No. 171 of 1998, P.S. Pasgawan, District Kheri. The petitioners are said to have surrendered before the learned Magistrate and they were granted bail and are on bail. The learned Magistrate treated it to be the case under Sections 325, 323, 504, 506 I.P.C. It is urged that they have not misused the liberty of bail granted earlier to them, but subsequently, Section 326 I.P.C. was added while submitting the chargesheet. In these circumstances, the petitioners apprehend that on account of new section, they will be taken into custody.

In these circumstances, this petition is disposed of finally with the direction to the learned Magistrate that in case the petitioners appear before him within a period of three weeks from today and furnish fresh bail bonds and personal bonds under the newly added section to his satisfaction, then they shall not be sent to Jail.

Direction issued.
