Judgment
Sheel Nagu, J.—Heard. This petition under Article 226 and 227 of the Constitution of India prays for the following reliefs:-
(i) That, the respondent authority may kindly be directed to set aside the posting of respondent no. 5 at Karera District Shivpuri and posted him elsewhere.
(ii) That, the other relief doing justice including cost be awarded.
On perusal of the pleadings contained in the petition, it appears that the petitioner has no personal grievance. Direction has been sought in this petition to set aside the order of transfer of respondent no. 5/Vishnu Sharma issued pursuant to the order dated 06.09.2013 (Annexure P/1) from Binaganj District Guna to Karera District Shivpuri.
Petitioner has no locus to assail the order of transfer of an employee, which does not adversely affect the petitioner, who is not in Government service but claims himself to be an active member of a political party.
It is settled principle of law that service matters can not be raised by any busy body without the petitioner being adversely affected by the order involving service dispute of another person. In view of the above, the petition filed by the petitioner is not maintainable and, therefore is rejected.
