Judgment
At the outset, Mr. K. R. Nair, learned counsel for the petitioners, would submit that the petitioners were appointed as Lab Technician in the
Government College on a higher pay scale than the pay scale of Assistant Librarian but after revision of pay, the Assistant Librarians are getting the
higher pay scale than the petitioners, therefore, the petitioners are also entitled to the pay scale as is being given to the Assistant Librarians in light of
the decision rendered by the Supreme Court in the matter of Anil Ratan Sarkar and others vs State of W. B. and others (2001) 5 SCC 327. The
petitioner has also made representation to the respondent authorities on 16.10.2002, but the same has not been considered and decided till now.
Learned State counsel would submit that the representation of the petitioner will be decided expeditiously.
Be that as it may, the State Government is directed to consider and decide the petitioners' representation in accordance with law and on its own
merits within 30 days from the date of receipt of copy of this order.
With the aforesaid direction, both the writ petitions stand disposed of. No order as to cost (s).
The petitioners are at liberty to make additional representation and additional submission in support of their claim.
It is made clear that this Court has not expressed any opinion on the merits of the case.
