The learned Advocate for the petitioner submits that the petitioner is seeking relief against the administrative sanction orders dated 07-03-2022 and 17-03-2022. The learned counsel further submits that this Court (Coram: R.D. Dhanuka and S.G. Mehare, JJ.) has passed the order on 2nd May, 2022 in Writ Petition No. 4359 of 2022 and granted liberty to the Gram Panchayat to release the funds after seeking permission of this Court. The said order is passed in respect of Ambajogai Taluka, District Beed.

By this petition, the petitioner is praying same relief for remaining talukas in district Beed, hence, requested to pass appropriate orders.

The learned AGP submits that main relief is sought against the Zilla Parishad.

As the Division Bench of this Court has passed the order in respect of the same work, which is challenged in this writ petition, hence, the respondent is directed that, ‘If the Grampanchayat proposes to release any funds in respect of the works allotted for the financial year 2021-2022, the Grampanchayat would be at liberty to release that funds after seeking permission of this Court.”

Issue notice to respondents, returnable on 11-07-2022. The learned AGP waives service of notice for respondent Nos. 1 and 2.

To test the bonafides of the petitioner and as a security, so also as per Rule 7-A of the Bombay High Court Public Interest Litigation Rules, 2010, the petitioner shall deposit an amount of Rs.1,00,000 (Rupees one lakh only) within a period of 15 days from today.
