Judgment
We have heard learned Counsel appearing for the parties extensively.
During the course of arguments, learned Counsel appearing for the State brought to our notice that there is a general order passed on 21.3.2003 terminating the services of the Petitioners herein which was not brought to the notice of High Court.
Mr. Mishra, learned senior counsel appearing for the Petitioners very earnestly suggests that this order dated 21.3.2003 was never communicated nor was it ever served upon the Petitioners and the Petitioners had no opportunity to challenge the same.
If that order remains, then nothing would remain in the present Special Leave Petition.
We also note from the affidavit of the Petitioner which we had directed to be filed, by our order dated 20.1.2011, that the Petitioners were not working after 2003.
Mr. Mishra, learned senior counsel seeks leave of the Court to withdraw this SLP with liberty to challenge the order dated 21.3.2003 before the appropriate authority including raising a labour dispute regarding the same. Permission granted. This SLP is accordingly, dismissed as withdrawn with the aforesaid liberty.
