Judgment
An affidavit has been filed pursuant to the orders passed by the Court in the present petition by the Secretary, Orissa State Housing Board, Bhubaneswar (OSHB) that in terms of the calculation of the Petitioners entitlement for differential arrears of salary as per the revised scale of pay Rules-1998 with effect from 1st January, 1996 the two Petitioners i.e., Sri S.K. Pani and Sri A.R. Nayak were entitled to get Rs.7.5Lakhs each.
It is further stated that the total amount of Rs.15Lakhs “is to be paid to both of the Petitioners towards their differential arrears salary”. It is added that the amount will be paid “when the financial condition will be improved as decided”.
Learned counsel for the OSHB today informs the Court that the financial condition of the OSHB is still weak therefore, it is unable to make the above payment. Considering that the OSHB is a State Government undertaking a direction is issued that in view of the financial difficulty expressed by the OSHB, the Government of Orissa, Housing and Urban Development Department shall to bail out the OSHB ensure that the above payment of Rs.7.5Lakhs each to the two Petitioners is made as a one-time measure on or before 20th June, 2022.
A compliance affidavit shall be placed on record in this petition before the next date.
