Objection of registry on question of maintainability is overruled.
This is first criminal revision which is preferred by the applicant before this Court against order dated 14.03.2024 by which Revisional Court has remanded the matter back before the trial Court for reconsideration of complaint filed by respondent.
Learned senior counsel appearing for applicant submitted that allegations made in complaint and statements recorded does not make out an offence under Sections 354(d), 294, 506(Part-II) and 456 of Indian Penal Code.
Heard the counsel for applicant.
Perused the complaint and also the statements. Ingredients of criminal course and assault are missing in complaint as well as in oral statement recorded in Court.
Considering aforesaid, till next date of hearing order dated 14.03.2024 shall remain stayed.
7 Issue notice to respondent on payment of P.F. within seven days.
Notice be made returnable within four weeks.
List the matter in the week commencing 06.05.2024.
