SANJAY KUMAR vs G.P.O., KASHMERE GATE, DELHI

A complaint has been made by Shri Sanjay Kumar stating that a money order No. 2233 of Rs. 1,000/- was sent by him on 21.11.1997 through Seelampur Post Office, Delhi-110053 to Shri Dinesh Kumar but the same has not been received by the addressee even after 7 months. He has further stated that he made complaints on 11.1.1998 and 2.3.1998 but no action seems to have been taken by the Postal Authorities.

WE have heard the applicant/ complainant. A perusal of the enclosure reveals that the complaints have since been received by the Postal Authorities and an enquiry is being made. In other words, the complaint is being looked into by the Post Master, G.P.O., Kashmere Gate, Delhi and whatever relief is admissible, will be given to the applicant/complainant. The complaint however, does not disclose any unfair or restrictive trade practice by and on behalf of the Post Master of the concerned Post Office. Moreover, the Deptt. of Post and the Post Master of a Post Office are not amenable to the jurisdiction of this Commission. Even otherwise, according to Section 4 of the MRTP Act, 1969, the provisions of this Act are in addition to and not in derogation of any other law for the time being in force and the provisions of this Act are intended to supplement and not to supplant any other law in force. (The Indian) Post Office Act, 1898 is in force and the complainant can seek appropriate relief under its relevant provision. In view of our aforesaid discussion, the complaint appears to be misconceived and is hereby, rejected summarily. Complaint dismissed.
