Judgment
Kanwaljit Singh Ahluwalia, J.—By this common order, both the petitions, viz. (1) Criminal Misc. No. M-27415 of 2010 preferred by Sanjay Kaul and (2) Criminal Misc. No. M-33747 of 2010 filed by Parkash Sharma u/s 439 Code of Criminal Procedure seeking regular bail to the Petitioners in case FIR No. 339 dated 10.08.2010 registered at Police Station Division No. 5, Ludhiana under Sections 420, 419, 406 and 120B IPC shall be decided together.
The allegation against the Petitioners is that they have duped various persons on the pretext that work-visa shall be issued for settling them abroad. The Petitioners are stated to be in custody since 10th August, 2010. It is submitted that the investigation has concluded and a report u/s 173 Code of Criminal Procedure has also been submitted against the Petitioners. Furthermore, the Petitioners have been charged for the offences and trial is in progress.
It is a case of magisterial trial, which will take a long time to conclude. This Court is of the opinion that further detention of the Petitioners in this case is not warranted. Accordingly, they are ordered to be released on bail, to the satisfaction of Chief Judicial Magistrate, Ludhiana.
With the observations made above, both the present petitions are disposed of.
