The petitioner has filed a memo stating that hand summons have been served on the respondent Nos. 1 and 2. In spite of service of notice, none appears for the respondent Nos. 1 and 2.
The case of the petitioner is that she was a student of respondent No.1-institution and she has successfully completed MBBS course. It is submitted that the respondent No.1-institution is illegally withholding her MBBS, PUC and SSLC marks card on the ground that petitioner owe certain money to respondent No.1-institution. It was further submitted that she needs the said marks card for her admission to M.D. course immediately.
MBBS, PUC and SSLC marks card of the petitioner are the properties of the petitioner. The respondent -institution cannot withhold the same. If the petitioner owe any money to the respondent No.1-college, it is always open for the respondent No.1 to initiate proceedings to recover the same in accordance with law but withholding the marks card for that reason is illegal.
Hence, the following;
ORDER
(1) Respondent No.1 is directed to hand over the MBBS, PUC and SSLC marks card of the petitioner, if the same are in its possession, forthwith. The writ petition is disposed of accordingly.
