Judgment
S.K. Agarawal, J.—Heard learned Counsel for the applicant and learned A.G.A.
This is a case in which the alleged recovery is 100 gm. Morphine. Admittedly this is case of opium growing belt and the area is an industry in the manufacturing of the Morphine. It is shocking that when this applicant was arrested except an ornamental compliance of Section 50 of the N.D.P.S. Act serious endeavour was made by the SubInspector concerned to find out the arrest of the accused from whom this accused disclosed to obtain this Morphine. His name has been disclosed in the FIR as Kunnu alias Bulai. This case was completed without taking steps against Kunnu. Generally it is found in the majority of the F.I.Rs. that the police personel affecting the arrest of the carriers never tried to find out the real culprits who are running the industry in the Narcotic and Substances drugs for the reasons best known to them.
In the circumstances without adverting any further to the merit of the contention let the applicant be enlarged on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the Chief Judicial Magistrate/Special Judge (N.D.P.S. Act), Barabanki, in case Crime No.124 of 2001 under Section 8/21 of N.D.P.S. Act, P.S. Zaidpur, District Barabanki.
