Petition is directed against the order dated 06.05.2024 passed by Member, IInd Motor Accident Claims Tribunal, District Morena in Claim Case No.358/2016, titled as Mahila Sharda Devi and others Vs. Sangram Singh Dhakad and others, by which the application under Section 65 of the Indian Evidence Act moved by the defendants/petitioners has been dismissed.

Learned counsel for the petitioners submits that insurance policies issued by the Insurance Company in favour of the petitioners are alleged to be fake and forged, while he has deposited the payment through cheque. Thus, he moved an application to prove both the insurance policies as secondary evidence. In written statement filed by both the Insurance Companies, insurance policies are said to be forged. Insurance Company clearly stated that no policy has been issued by the Insurance Company on the alleged chassis and engine numbers.

3 . Evidently, claim petition filed before the Motor Accident Claims Tribunal, Morena has been pending since 2016 and the petitioners have been directed to adduce their entire evidence on the next date.

4 . Upon considering the facts and circumstances of the case and submissions made by the counsel for the petitioners, I do not find any illegality or irregularity, legal or otherwise, warranting interference in the impugned order.

In view of the above, the petition is accordingly dismissed.
