Judgment
Petitioner filed the instant writ petition assailing the letter dated 26.04.2019 (Annexure P-9) issued by the Head of Divisional Office, Gurgaon of Indian Oil Corporation Limited and whereby the application submitted by the petitioner for award of Retail Outlet Dealership at Village Chitapuri on National Highway 71 to Budana Road, Block Rewari, District Rewari under the Open Category was dealt with and it was informed that pursuant to a visit by the Land Evaluation committee, petitioner has not been found eligible under Group-1 and would now be considered under Group-3.
On a previous date of hearing a copy of the writ petition has been handed over to Mr. Ashish Kapoor, learned counsel representing Indian Oil Corporation Limited so as to complete instructions.
During the course of resumed hearing today Mr. Ashish Kapoor, Advocate has informed the Court that the candidature of the petitioner under Group-1 was not considered valid on account of certain discrepancy in the description of land/Khasra number. He however apprises the Court that a decision in principle has been taken by the respondent-Corporation to treat such discrepancy under the category of rectifiable deficiency and accordingly 21 days time in writing would be given to the petitioner to submit necessary documents to demonstrate the eligibility under Group-1 for the site in question.
In view of such categoric stand taken, the decision contained in the impugned letter dated 26.04.2019 at Annexure P-9 does not survive.
Writ petition is disposed of in terms of accepting the statement made by Mr. Ashish Kapoor, Advocate representing the respondent-Indian Oil Corporation Limited.
Disposed of.
