Judgment
This is a letter petition which has been registered as Habeas Corpus.
The brief facts of the case are that the petitioner is aggrieved by the fact that on 18.01.2022 around 8:00 AM, her minor daughter, Ms. ‘S’, aged 15 years went missing from home and did not return back. Petitioner has apprehension that she was taken away by her neighbor Vishal, aged 30 years.
Mr.Sanjay Lao, learned Standing Counsel has handed over latest status report dated 18.01.2024 wherein it is stated that police has taken all the steps to trace out the missing girl, however, till date, no clue is found. With regard to the suspect, FIR No.49/2022 has already been registered at police station Sagarpur for the offence punishable under Section 363 IPC. Moreover, said suspect i.e. Vishal has already been declared a proclaimed offender by the concerned Metropolitan Magistrate on 23.12.2022.
The status report dated 18.11.2023 is taken on record and we have perused the same.
Learned Standing Counsel has also produced school documents, according to which the date of birth of the missing girl is established as 04.08.2006 which has been verified and is found to be correct. He further submits that in the latest status report dated 18.01.2024, the date of birth of the missing girl is inadvertently mentioned as 08.08.1996 whereas the exact date of birth is 04.08.2006.
In light of the aforesaid discussion, since all possible efforts to trace the missing girl have been made, we hereby dispose of the present writ petition directing the concerned police officials to file a monthly status report before the concerned Metropolitan Magistrate and if any clue is found about the minor daughter of the petitioner, the same shall be communicated to her and if she is rescued, she be produced before the concerned Metropolitan Magistrate.
With directions as aforesaid, the petition is disposed of.
