TRP (CRL) No.72 of 2022 & I.A. No.74 of 2022
This application has been filed by the petitioners under Section 407 of Cr.P.C. seeking transfer of CRP No.123 of 2022 filed by them under Section 125 of Cr.P.C. for maintenance in the Court of learned Judge, Family Court, Bhubaneswar, to the Court of learned Judge, Family Court, Jajpur.
Mr. Padhi, learned counsel submits that the CRP No.123 of 2022 had been filed in Bhubaneswar when the petitioners are staying there. Presently, the petitioners are residing with the father of the petitioner No.1 at Jajpur, for which, the petitioner No.1-wife is facing difficulty in pursue the case as the distance between Bhubaneswar to Jajpur is about 80 K.M.s and presently the petitioner No.1 has no independent source of income.
Considering the above submissions, issue notice to the opposite party in the TRP (CRL) as well as in the I.A. through Registered Post with A.D., returnable within four weeks, requisites for which shall be filed by 28.09.2022. One set of process fee shall be accepted.
