Interim Relief Application (I.A. No. 06 of 2022)

1) Issue notice.

Mr. Vikas Pande, learned Standing Counsel accepts notice on behalf of respondent Nos. 1 and 2.

Mr. Mukesh Kumar Kaparuwan, learned counsel, accepts notice on behalf of respondent No. 3.

2) This application has been moved on behalf of respondent No. 1 to permit respondent No. 1 to issue the proposed Rules which are proposed to be named as the “Uttarakhand Subordinate Nursing (Non-Gazetted) Service (Amendment) Rules, 2022”.

3) There is no interim order passed by us in the present matter. Learned counsel submits that this application has been moved out of deference before the Court as the present petition is pending.

4) It is open to the respondent authorities to amend the existing Rules. The application is, accordingly, allowed. However, we make it clear that we have not examined any aspect with regard to the legality or otherwise of the proposed amendment Rules.

5) The application stands disposed of in the aforesaid terms.

6) Counsel for the petitioners submits that in the light of the amendment which the respondents have now proposed to incorporate in the existing Rules, this petition has become infructuous, and it may be disposed of as such.

7) The writ petition is, accordingly, disposed of as infructuous.
