The Review Application has been filed by the Petitioners.

Learned Counsel for the review applicants submits that in a similar nature of writ petition, in the case of Kamlapati Tripathi Versus District Basic Education Officer, Ambedkar and others [2005 (23) LCD 1196] has held that ...Anganbadi Karyakatri are not the government servants nor they hold Civil Post, that is why, the writ petition filed by Kamlapati Tripathi was dismissed by this Court. Further, he submits that in the judgment of Kamlapati Tripathi, it has been held that the writ petition was dismissed on the ground of nonmaintainability of writ petition, whereas following the judgment of Kamlapati Tripathi, the present writ petition has been disposed of; rather has to be dismissed.

Accordingly, the Review Application is allowed and the order dated 6.2.2009 is modified to the extent that with the consent of learned counsel for the parties, I proceed to hear the case finally and the writ petition is dismissed in terms of the judgment passed in Kamlapati Tripathi (supra).
