Judgment
Prafulla C. Pant, J.—Applicant - Sandip, who is in jail in connection with crime No. 88 of 2011, relating to offence punishable u/s 8/20 Narcotic Drugs & Psychotropic Substances Act, 1985, Police Station Kotdwar, District Pauri Garhwal, has sought his release on bail.
Heard learned Counsel for the parties.
One kg., of cannabis (CHARAS) is said to have been recovered from the applicant. Co-accused who is said to have been found in possession of 956 gMs., of charas has already been directed to be released on bail. It is pleaded that applicant has No. criminal history.
Having considered submissions of learned Counsel for the parties, and after going through the papers on record, without expressing any opinion as to final merits of the case, this Court is of the view that applicant deserves bail.
The bail application is allowed. Let the applicant Sandip be released on bail on executing personal bond, and furnishing two sureties each of the like amount to the satisfaction of court concerned.
