The petitioner is the owner of a residential building bearing No.1816B/56 in Kochi Corporation covered by Ext P1 certificate.

It is the case of the petitioner that the fourth respondent, her neighbour, has constructed a two storied building without any pillars or foundation,

which is touching the sunshade of the petitioner's building. The petitioner is apprehensive that the building of the fourth respondent would collapse at

any time. In the said circumstances, the petitioner has submitted Ext P4 complaint before the third respondent as early as on 17.3.2021. However,

there is inaction on the part of the third respondent in considering Ext P4. Hence, the writ petition.

Heard the learned counsel appearing for the petitioner, the learned Standing Counsel appearing for the respondents 1 and 2 and the learned

Government Pleader appearing for the third respondent. In view of the limited relief that I propose to pass, I have dispensed with notice to the fourth

respondent.

Taking note of the fact that the petitioner has submitted Ext P4 complaint before the third respondent, I deem it appropriate to direct the third

respondent to consider and dispose of Ext P4 after affording the petitioner and the fourth respondent an opportunity of being heard. The third

respondent shall issue notice of hearing to both the petitioner and the fourth respondent and dispose of Ext P4, in accordance with law, as

expeditiously as possible.

The writ petition is ordered accordingly.
