Judgment

Mr. Prusty, learned advocate appears on behalf of petitioner. He submits, his client's application for award of dealership was rejected saying that land offered for godown is not meeting the 21 mtrs. by 26 mtrs. requirement. He refers to annexure-7 in the writ petition and submits, the Tahasildar had given measurement of his client's plot at, inter alia, 22 mtrs. facing road side.
Mr. Nayak, learned advocate appears on behalf of the oil company and submits, at page 52/73 of his client's counter is the field verification sketch prepared by the Revenue Inspector. It is clear therefrom that road side length of the plot is 19.23 mtrs. being less than 21 mtrs. Hence, petitioner's candidature was rejected and another person selected.
Petitioner wants physical verification by Special Officer. Court appoints to Mr. Rakesh Behera, advocate as Special Officer, to visit the plot upon prior notice to learned advocate for the oil company. The Special Officer shall have length of the plot facing road side measured and report to this Court. Petitioner will pay Special Officer remuneration of Rs.15,000/- at first instance. He will also make arrangement to take Special Officer to the plot. Report is to be filed on adjourned date. Petitioner will serve copy of this order on local administration, i.e., the Tahasildar, Bolgarh, who is to provide a competent person to identify the plot as in annexure-7 to the writ petition.
