This Crl.M.C has been filed to quash all further proceedings in C.C.No.670/2016 on the file of the Judicial First Class Magistrate Court-II, Cherthala.
The petitioner is the accused. The offences alleged against him are punishable under Sections 294(b) and 179 of the IPC and Section 117(e) of the Kerala Police Act.
The prosecution case in short is that on 31.10.2015 at 7.55 pm, the 2nd respondent contacted the number of petitioner from his official phone number to enquire about a complaint regarding a girl missing case and the petitioner refused to give answer to the question put by the 2nd respondent, further used obscene words against the him and thereby committed the offences.
I have heard Adv. Lakshmy S., the learned counsel for the petitioner and Sri. P.G. Manu, the learned Senior Public Prosecutor.
I went through the final report and the statement of the witnesses. There are materials to attract the ingredients of the offences alleged against the petitioner. When prima facie case is made out, the jurisdiction vested with this Court under Section 482 of Cr.P.C cannot be invoked. Accordingly, the Crl.M.C is dismissed.
