Petitioner-complainant has assailed the judgment of acquittal passed in Crl.A. No. 57/2011 by the learned I Additional District and Sessions Judge, Davangere in a case related to dishonour of cheque. Trial Court had found the accused guilty and passed judgment of conviction and order of sentence, which was reversed by the appellate Court. Office has raised objections regarding maintainability of the petition, based on the ratio of law in the case of K.H. Ganesh Rao Vs. H. Gopal Bhandari, .

Heard learned Counsel appearing for the petitioner and perused the impugned judgment. The objection raised by the Registry with regard to maintainability of the revision petition is justified, in view of the ratio of law in the decision, noticed supra. Consequently, while upholding the office objection, petitioner is permitted to convert this revision petition into a criminal appeal.

Two weeks time is allowed for carrying out of the amendment.

For statistical purpose, this criminal revision petition is disposed of.
