Judgment
Petitioner seeks regular bail in case arising out of FIR No.103 dated 12.06.2026 under Sections 117(2), 115(2), 126(2), 351(2), 190, 191(3) Bharatiya Nyaya Sanhita, 2023 Police Station City Sangrur, District Sangrur. Section 140(4) BNS was added in the FIR during investigation. This is the first petition for regular bail.
Complainant Arundeep Joshi alleged that he worked as a driver on his own vehicle. On 09.06.2026, when he was at his parents' house, Jaggi Walia took him on his scooter to his Haripura house on the pretext of talking to his elder brother regarding sending his (complainant's) son abroad. Complainant rode on his scooter towards Haripura. On the way, at about 8.30 PM, he was intercepted by unknown persons, who punched him on the nose. In the meanwhile, Mota son of unknown, resident of Banda Bahadur Colony, Sangrur reached, pushed him off the scooter and forced both of them to get into a car belonging to Lucky Moudgil, who was driving the car
with one other person sitting in it. Mota hit him on the head with some iron object and punched him. He was taken to the cremation ground of some village about 10 kilometers away, where he was assaulted by Lucky Moudgil, Mota, Bundy Bania and Mithu Baba with sticks, iron rod. Assailants threatened to kill him and recorded a video of him saying that he entered their house forcefully in the night to attack their women.
Learned counsel for the petitioner submits that petitioner had been falsely implicated in the case. He was neither alleged to be involved in abduction of the complainant nor he was stated to be present at the cremation ground. The only role attributed to him was that when the complainant was brought in the car of co-accused Lucky to Prem Basti, petitioner hit him with iron rod, at the house of Lucky. He further submits that petitioner was in custody with effect from 25.07.2026. Though, he was involved in 1 other case, he was on bail in that case. Investigation was complete and trial was likely to take long. Therefore, petitioner deserved to be enlarged on regular bail.
Custody certificate dated 22.09.2026 has been filed by State of Punjab, which is taken on record. Learned State counsel has opposed the prayer for regular bail arguing that the complainant was brutally assaulted and suffered 4 grievous injuries besides 4 simple ones. Considering the gravity of allegations against the petitioner, he did not deserve the concession of regular bail.
Petitioner is in custody since 25.07.2026. Investigation of the case is complete and trial which is at nascent stage, is not likely to conclude soon. Considering the role attributed to the petitioner, since there is no reason to believe that he would abscond from the trial or tamper with the
evidence, the petition is allowed. Petitioner is ordered to be released on regular bail subject to his furnishing adequate bail and surety bonds to the satisfaction of trial Court/Duty Magistrate concerned.
Pending miscellaneous applications, if any, stand disposed of.
