The FIR No.47/2022 dated 06.05.2022 was registered at Police Station, Kala Amb, District Sirmour for the commission of offences punishable under Sections 306, 498A of IPC. The parties have compromised the matter. The informant-father of the deceased made a statement on 15.09.2023 that he had compromised the matter with the parties as per the compromise deed (Annexure P-1) and he has no objection, in case, the FIR is ordered to be quashed.
Mr. Prashant Sen, learned Deputy Advocate General for respondent no. 1 submitted that keeping in view the nature of the offences, the permission should not be granted to compound the offences; hence, he prayed that the present petition be dismissed.
This Court has quashed the FIRs registered for the commission of an offence punishable under Section 306 IPC inter alia, in Sunita Kaushal versus State of H.P, Cr.MMO No.89 of 2016 decided on 07.04.2016, Ashok Kumar and others versus State of H.P. 2020 CRI. L. J. 350 = Latest HLJ 2019(2) (HP) 1424 = 2019 (3) Shim. LC 1684 and Mohammed Arif and others versus State of H.P. and anr, Latest HLJ 2021(HP)(2) 1315.
Therefore, keeping in view the earlier precedents, the FIR No.47 of 2022 dated 06.05.2022 registered at Police Station Kala Amb, District Sirmour for the commission of offences punishable under Sections 306, 498A of the IPC and subsequent proceedings arising out of the same are ordered to be quashed as per the compromise.
