Judgment
This Application I.A No. 1580 of 2022 has been filed by the Applicant seeking stay of the recovery of possession of Residential Flat No. 6, Gold Croft Apartment CHS, 39, Bhulabhai Desai Road, Mumbai-400026. The Applicant does not dispute that this flat belongs to the Corporate Debtor and Interim Resolution Professional (IRP) has already sent an e-mail to them to vacate from the premises.
Learned Counsel for the Applicant submits that the old age personnel are living in the flat and they require some time to make some alternate arrangement.
We are of the view that the occupants of the flat shall not be asked to vacate the premises till 11.07.2022 which is the next date in Appeal. However, we make it clear that it shall be open for the Applicant/ Appellant to make alternate arrangement before the date fixed. It shall also be open to the occupants to approach the RP for any arrangement with RP, if any.
Application I.A. No. 1580 of 2022 is disposed of accordingly.
