Judgment
Appellant appearing in person draws our attention to the order dated 08.07.2022 of the State Commission Mahrashtra, Mumbai recording that the time given by the Hon’ble Supreme Court for payment of amount by the Applicants to CIDCO has expired and that no extension of time has been sought by the Applicants and that Mr. Bhushan Jain appearing in person was being given last chance to seek extension of time before the Hon’ble Supreme Court.
Mr. Ajit Bhasme, Learned Sr. Counsel appearing for the Respondents draws our attention to the order dated 24.03.2021 of the Hon’ble Supreme Court in SLP Nos.4589-4591 of 2021 wherein it has been directed as under:
Having perused the record we see no error in the order of the National Consumer Disputes Redressal Commission dated 20 January 2021 in First Appeal Nos. 300-302 of 2013. Mr. Buxy however submits that the time of eight weeks which has been granted by the NCDRC to deposit the balance consideration together with interest at the rate of 12% per annum has expired and an extension of time may hence be granted. In order to facilitate compliance with the order of the NCDRC, we extend time for payment of the balance consideration inclusive of interest by a further period of eight weeks from today.”
The Appellant submits that he has not been able to approach the Hon’ble Supreme Court for extension of time since he has not been issued letter of allotment from CIDCO and that he has paid excess of the amount that was required to be deposited by him. The same is denied by the learned Counsel for the Respondents.
The Appellant is directed to approach the Hon’ble Supreme Court with the documents related to the payments and seek either extension of time or recall of the order dated 24.03.2021.
The Appeal Executions are disposed of in the above terms with liberty to the Appellant to approach this Commission in case of any directions from the Hon’ble Supreme Court.
