The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.63/2021 registered at Police Station Dantor, District Bikaner for the offence punishable under Sections 8/15 & 29 of NDPS Act.

Learned counsel for the petitioner submits that the Investigating Officer was examined in Court as PW-1 wherein he has clearly mentioned that no call details were available between the petitioner and the co-accused. Counsel further submits that petitioner has nothing to do with this alleged recovery. Therefore, the benefit of bail should be granted to the accused-petitioner.

Learned Public Prosecutor and Mr. Ramkera, ASI present-in-person have opposed the prayer made by the counsel for the petitioner for bail.

I have considered the arguments advanced before me and carefully gone through the record.

Mr. Ramkera, ASI, present-in-person submits that on the day when recovery was made, the petitioner conversed with the other co-accused for about four times on the mobile phone and the call details between the petitioner and co-accused are also available on record. Therefore, this Court is not inclined to grant benefit of bail to the petitioner.

In the above circumstances, the present bail application filed by the petitioner is hereby dismissed.
